Nukiholic Intellectual Property Policy

Nukiholic provides an online marketplace for users to design and sell custom T-shirts and merchandise. To maintain a fair and creative platform, we strictly prohibit the creation or sale of products that violate intellectual property rights, including copyrights, trademarks, and related protections.

If you believe your intellectual property rights have been infringed on Nukiholic, please follow the steps below to report the violation.


A. Reporting Intellectual Property Infringement

Content Removal

Upon receiving a valid infringement notice, Nukiholic will act in good faith to remove or disable access to the infringing content.

Repeat Violations

Accounts with multiple infringement reports may be permanently terminated.

To report a violation, submit a notice to our Designated Agent with the following details:

  • Identification of the infringed intellectual property (e.g., copyright or trademark), including registration numbers if available.
  • Details of the infringing content, including:
    • A description of how the content infringes your rights.
    • The URL or specific page where the content is located on the Nukiholic platform.
  • Your contact information, including full name, mailing address, phone number, and email.
  • A sworn statement, under penalty of perjury, affirming that the content is being used without authorization.
  • A sworn statement confirming that your notice is accurate and that you are the rights holder or authorized to act on their behalf.
  • Your electronic or physical signature.

B. After Receiving an Infringement Notice

  • Content Removal: Nukiholic will promptly remove or restrict access to the reported content.
  • Notification to the User: The content owner will be informed of the action taken.
  • Repeat Offenders: Accounts with multiple infringement reports may face permanent termination.

C. Submitting a Counter-Notice

If you believe your content was removed by mistake or that you have the right to use the material, you may submit a counter-notice containing:

  • Identification of the removed content, including its location before removal.
  • A sworn statement, under penalty of perjury, confirming that the content was removed due to error or misidentification.
  • Your contact details, including full name, mailing address, phone number, and email.
  • A statement consenting to the jurisdiction of the Federal Court in your district (or Nukiholic’s location if outside the USA).
  • Your electronic or physical signature.

If a counter-notice is received, Nukiholic may notify the original complainant. Unless legal action is taken, the content may be reinstated within 10–14 business days, at Nukiholic’s discretion.


Important Notice

Under Section 512(f) of the DMCA, anyone who knowingly submits a false claim of infringement may be held legally responsible for damages, including attorney fees.
